Terms and Conditions applicable to Online Entries at UKForms

 

This page summarises the important information about UKForms and the terms and conditions relating to the website. By entering an event via UKForms you are deemed to understand, be in agreement with and accept the conditions below.

If you need to contact me for any reason concerning any entry made via this site, please use the Contact Page (link at the top of the page) and give me full details of the transaction involved, the race you are enquiring about, the amount paid and the date you submitted your entry. I will endeavour to reply within 24 hours (subject to holidays etc.) and to resolve any issue to your satisfaction where I can. I prefer email communication but, if you wish to telephone, you may do so on 07547 791117 during office hours. If I am unavailable, please leave a message and I will return your call.

If I need to contact any of the card processing companies used by this site (Paypal and Nochex), please be aware that their investigations and replies may take a few days and any delay caused by those investigations is outside my control. You can also make payment via internet banking. Please contact me for account details if you wish to use this method.

To use the entry forms on this site, complete them fully then check your details on the verification page. Once you are happy that these are correct, you can submit your entry and proceed to pay. Please note that UKForms is not responsible for the accuracy of the information that you provide when entering an event. You are asked to confirm that your details are correct before submitting your entry, and it is your responsibility - not UKForms - to ensure you provide the correct details during this process. UKForms cannot be held liable for any problems that occur as a result of errors on the entry form.

If you have any problem with payment, you should contact me, as above, and I will try to help. Your entry can only be accepted, and the transaction be completed, once a completed entry form and payment is received. Until then you have not been accepted into your chosen event. Only when an email is issued to you to confirm your entry have you been successfully entered.

Once your payment has been received and matched with your entry, you will be sent confirmation of your entry via email. Please note that if you fail to supply a valid email address, or spell your email address incorrectly, I will not be able to contact you to acknowledge your entry. If an email is returned to me undelivered, I cannot second guess what your email address should be - so if you want a confirmation of your entry via email, make sure you have typed it correctly in the first place! Also, please check your junk / spam email folder before you contact me to say you haven't been sent confirmation of your entry. 9/10 times, the confirmation email is in there.

Your details will then be forwarded to the Organiser or the person responsible for entries for your chosen event. Submitting an online entry form without a payment DOES NOT guarantee you a place in an event. PAID entries take priority over UNPAID entries! On occasion, you might submit an entry then experience a problem making payment. Inbetween submitting the entry and resolving the payment problem the Race Organiser may instruct UKForms to close online entries due to event having reached its maximum capacity. UKForms cannot accept responsibility for your disappointment should your entry to the event subsequently be declined due to this happening. Please note that events are listed on the website months in advance of the race itself. Please don't leave it until the last minute to enter!

Payment is made to the Event Organiser or Organising Body in accordance with the agreement I have with them. Refunds are at their discretion once they have received your entry - I cannot presume that they will agree to allow a refund (most races don't) and so can only refund your money if I am authorised to do so. Refunds made for any reason will not include the UKForms administration fee you paid during the booking process as UKForms is charged by Paypal and Nochex for both receiving your money AND refunding it back to you! Refunds can only be made to the card with which you paid unless more than 60 days have passed since the original transaction. If this is the case I will need to agree a refund method with you. Additionally, if you paid by internet banking or over the counter, you will also need to agree a repayment method with me. In the event that you have made an error with your payment (e.g. if you paid twice) then I can deal with refunds quickly once I am alerted to the problem. Please bear in mind that some people pay for others with a single card so it is not always easy to detect when an error has occurred.

UKforms only acts as an Agent for the event you have chosen to enter and has no direct involvement in any of the races, unless specified. If you have any queries about the event, or you are unhappy with some aspect of it, you should direct your correspondence to the Race Organiser and not to UKForms. As Entrants enter a race through the Website, UKForms will collect all entrance money and hold it as the Organiser's Agent. Whilst the entry money is collected by UKForms, no contract is entered into between UKForms and an Entrant. Entrants are entering into a contract with the Event Organiser and not UKForms. Should any event be cancelled or not take place for any reason including the Event Organiser becoming bankrupt/insolvent or having acted in a fraudulent manner, UKForms will NOT be liable for the refund of your entrance fee. You are entering into a contract with the Event Organiser - NOT UKForms. UKForms operates under the principal of 'Caveat Emptor'.

Most events opt for online entrants to collect their numbers on the day of the race, to keep costs down. Others will post your number and race information to you. Each entry form carries information about the appropriate delivery method for your race pack (if any). It is important that you carefully read the information on the entry form and the disclaimer before agreeing to the terms.

All transactions entered into by UKforms (on behalf of any Race Organiser) with the Entrant are subject to the Consumer Protection (Distance Selling) Regulations 2000. This stipulates that the Entrant has the right to cancel the contract and that such cancellations must be notified in writing to the seller within a period of 7 working days from date of receipt of goods. As there is not necessarily any "delivery" as such, cancellations should be notified within 7 days of receiving confirmation of receipt from UKforms. Cancellations may be entertained at a later date totally at the discretion of the individual Event Organiser.

By entering an event via UKForms you are confirming your acceptance of the above terms and conditions without exception in addition to any terms and conditions imposed by the event itself.

Race Organisers - If an event is cancelled for any reason, UKForms reserves the right to make a variable charge per entry processed up until the time that the event is cancelled. This charge is necessary to cover the costs incurred in the processing of an entry and any subsequent refund.

UKForms will contact the Race Organiser (or primary contact) shortly after the event and supply a breakdown of payments owed to the club/event. You will be required to confirm that you are happy with the payment breakdown and supply your club bank account details to enable UKForms to make payment of the entry fees taken. UKForms will chase for these details on at least two occasions however if, after a 6 month period, the Race Organiser has not supplied the required bank details and/or confirmed that the calculations are acceptable, all race entry fees will be assumed as no longer required and will transfer by default to UKForms.

As an Event Organiser, it is important that you understand that an entry via UKForms constitutes a contract between the Entrant and the Event Organiser directly and no contract is being entered into between the Entrant and UKForms. As such, should an event not take place for any reason, you as Event Organiser will be wholly responsible for any subsequent claims for refunds of entry fees and equally liable for any resulting legal action taken against the Event. UKForms acts only as an Agent for events and is not responsible for the event itself.
